Building a national unified market is the fundamental support and inherent requirement for constructing a new development pattern. To accelerate the construction of a national unified market from a global and strategic perspective, the following opinions are proposed.

 

I. Overall Requirements

  

(1) Guiding Ideology. Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, fully implement the spirit of the 19th National Congress of the Communist Party of China and its subsequent plenary sessions, promote the great spirit of party building, adhere to the general principle of seeking progress while maintaining stability, fully, accurately, and comprehensively implement the new development concept, accelerate the construction of a new development pattern, deepen reform and opening up comprehensively, adhere to innovation-driven development, promote high-quality development, take supply-side structural reform as the main line, with the fundamental purpose of meeting the people's growing needs for a better life, coordinate development and security, fully leverage the guiding, normative, and safeguarding role of the rule of law, accelerate the establishment of a nationwide unified market system and rules, break local protectionism and market segmentation, unblock key bottlenecks restricting economic circulation, promote the smooth flow of goods, factors, and resources on a larger scale, accelerate the construction of an efficient, standardized, fair, competitive, and fully open national unified market, comprehensively promote the transformation of China's market from large to strong, and provide strong support for building a high-standard market system and constructing a high-level socialist market economy system.

Strengthen regulation of unfair competition behaviors in new business forms such as platform economy and sharing economy, rectify online black and gray industry chains, and govern new types of online unfair competition behaviors. Improve cross-department and cross-administrative region information sharing and coordination mechanisms for anti-unfair competition law enforcement, enhancing the unity, authority, and coordination of law enforcement. Build cross-administrative region mechanisms for case transfer, law enforcement assistance, and joint law enforcement in anti-unfair competition cases, and keep consultation channels and discretion standards open for new, difficult, and typical cases.

  

(24) Break down local protectionism and regional barriers. Guide regions to comprehensively compare advantages, resource and environmental carrying capacity, industrial foundation, disaster prevention and risk avoidance capabilities, accurately position their functions, avoid blindly pursuing scale and foreign investment, low-level repetitive construction, and excessive homogeneous competition, avoid "small but complete" self-contained cycles, and never engage in regional blockades under the name of "internal circulation." Establish and publicly disclose a directory of enterprise-related preferential policies in a timely manner, promptly clean up and abolish policies containing local protectionism, market segmentation, designated transactions, and other obstacles to a unified market and fair competition, comprehensively clear discriminatory and protective preferential policies against foreign-funded and non-local enterprises, and strictly conduct fair competition reviews for newly introduced policies. Strengthen coordination and cooperation on industrial transfer projects between regions, establish mechanisms for coordinating and resolving major issues, and promote further optimization of industrial layout and division of labor. (Twenty-five) Eliminate and abolish regulations and practices that hinder lawful equal access and exit. Except as explicitly stipulated by laws and regulations, enterprises shall not be required to register in a specific location, nor shall obstacles be set for enterprises to operate or relocate across regions. Unreasonable and discriminatory access and exit conditions shall not be set to restrict the free flow of goods, services, and factor resources. Access barriers shall not be established or disguised in the form of filing, registration, annual inspection, recognition, certification, designation, or requirements to establish branches. In terms of qualification recognition and business licensing, no significantly higher qualification, technical, inspection, or evaluation standards shall be set for non-local enterprises compared to local operators. The preconditions and approval standards for administrative approvals, licenses, filings, and other government services shall be cleaned up and standardized. Government service matters shall not be converted into intermediary services. Without legal or regulatory basis, enterprises shall not be required to conduct self-testing, inspection, certification, appraisal, notarization, or provide proofs before government services. Disguised approvals and paid services are prohibited. Franchise rights shall not be granted to operators without fair competition, nor shall operators be restricted to purchase or use goods and services provided by specific operators.

  

(Twenty-six) Continue to clean up violations of unified market construction regulations and practices in the bidding and procurement field. The formulation of bidding and government procurement system rules must strictly follow national regulations for fair competition review and legality examination. It is strictly prohibited in bidding and government procurement to illegally restrict or designate specific patents, trademarks, brands, components, origins, or suppliers. Qualification, technical, and commercial conditions that do not match the specific characteristics and actual needs of bidding and procurement projects shall not be illegally set. It is forbidden to illegally restrict bidders by location, ownership form, organizational form, or set other unreasonable conditions to exclude or limit operators from participating in bidding and procurement activities. All regions and departments should fully recognize the importance of building a national unified market for constructing a new development pattern, effectively unify thoughts and actions with the decisions and deployments of the Party Central Committee, achieve nationwide coordination, unify the market, ensure smooth circulation, and ensure that all key tasks are implemented.

  

(Twenty-eight) Improve incentive and restraint mechanisms. Explore and study the national unified market construction standards and guidelines. Regions that actively promote and achieve outstanding results in the construction of the national unified market may be rewarded according to relevant national regulations. Dynamically publish lists of improper interventions in the construction of the national unified market, establish a system for typical case notifications, interviews, and problem rectification, and focus on resolving improper market interventions and unfair competition behaviors that hinder the construction of the national unified market.

The National Development and Reform Commission and the State Administration for Market Regulation, together with relevant departments, shall establish and improve a departmental coordination mechanism to promote the construction of the national unified market, increase overall coordination efforts, strengthen tracking and evaluation, promptly supervise and inspect, and promote all parties to implement effectively.
