The State Administration for Market Regulation recently issued the "Several Measures by Market Regulation Departments to Promote the Development of the Private Economy," proposing several measures to fully stimulate the vitality of the private economy. Regarding the fields of certification, accreditation, inspection, and testing, the document clarifies:
Promote mutual recognition and interoperability of certification results across industries and regions Deepen the reform of the compulsory product certification system and further simplify the CCC certification procedures. Fully promote the reform of the qualification approval system for certification bodies and advance the digitization of certification body approval certificates.
Support private enterprises in enhancing their standardization capabilities, participating in the formulation and revision of national standards, and providing opinions and suggestions during the national standard project initiation, drafting, technical review, as well as standard implementation information feedback and evaluation processes. Support private enterprises in leading the establishment of international professional standard organizations and actively promote standardization construction. Co-host the 2023 Private Economy Standard Innovation Conference with the All-China Federation of Industry and Commerce, carry out the Private Economy Standard Innovation Week activities, organize pilot "standard health check" for small and micro private enterprises, and promote various levels of the Federation of Industry and Commerce and affiliated chambers of commerce to actively carry out "standard leader" activities for private enterprises and "leading" activities for chamber group standards.
Carry out quality management system certification improvement actions for private enterprises to enhance their quality and technological innovation capabilities. Continue to carry out the "Metrology Service for Small and Medium-sized Enterprises" activities, sort out enterprise measurement needs, and provide metrology consulting and technical services for enterprises. Support private enterprises in participating in the construction of industrial metrology testing centers to improve their advanced measurement capabilities.

Several Measures by Market Regulation Departments to Promote the Development of the Private Economy
To thoroughly implement the decisions and deployments of the Party Central Committee and the State Council on promoting the development and growth of the private economy, fully implement the "Opinions of the CPC Central Committee and the State Council on Promoting the Development and Growth of the Private Economy" (hereinafter referred to as the "Opinions"), continuously optimize a stable, fair, transparent, and predictable development environment, fully stimulate the vitality of the private economy, and ensure the implementation of all tasks proposed in the "Opinions," the following measures are proposed.
I. Continuously Optimize the Development Environment for the Private Economy
1. Revise and issue a new version of the negative list for market access, promote all types of business entities to lawfully and equally enter industries, fields, and businesses outside the list, and continuously break down market access barriers. Optimize administrative licensing services, vigorously promote the standardization, normalization, and facilitation of licensing approval work. Support regions in exploring the application of electronic business licenses in bidding platforms for login, signing, and online contract signing.
2. Clean up and standardize the preconditions and approval standards for administrative approvals, licenses, filings, and other government services. Government service items shall not be converted into intermediary service items. Without legal or regulatory basis, enterprises shall not be required to conduct self-testing, inspection, certification, appraisal, notarization, or provide proof before government services.
3. Promote mutual recognition and interoperability of certification results across industries and regions Deepen the reform of the compulsory product certification system and further simplify the CCC certification procedures. Fully promote the reform of the qualification approval system for certification bodies and advance the digitization of certification body approval certificates.
4. Strengthen the supply of fair competition policies, accelerate the introduction of institutional documents such as the "Fair Competition Review Regulations," improve the framework of fair competition systems and policy implementation mechanisms, and adhere to equal treatment of all types of ownership enterprises. Timely clean up and abolish policies containing local protection, market segmentation, designated transactions, and other obstacles to a unified market and fair competition. Regularly release lists of improper interventions in the construction of a unified national market. Without fair competition, operators shall not be granted franchise rights, nor be restricted to operate, purchase, or use goods and services provided by specific operators.
5. Strengthen antitrust enforcement, strictly conduct operator concentration reviews according to law. Legally stop abuse of administrative power to exclude or restrict competition. Focus on promoting fair competition advocacy, gather social consensus on fair competition, and promote greater synergy in fair competition. Optimize standards for operator concentration declarations. Guide enterprises to fulfill compliance responsibilities and improve compliance awareness and capabilities. Increase guidance on responding to overseas antitrust litigation and investigations, enhancing enterprises' compliance awareness and rights protection capabilities. Conduct research and early warning on risks of overseas investment and mergers and acquisitions, and formulate compliance guidelines.
6. Deepen the classified management of enterprise credit risks. Optimize and improve the enterprise credit risk classification indicator system, promote the normalized use of classification results in "double random, one public" supervision, reasonably reduce the proportion and frequency of spot checks for low credit risk Class A enterprises, and continuously improve the scientificity and accuracy of classification. Encourage qualified regions to explore credit risk classification management for individual industrial and commercial households, farmers' professional cooperatives, and other business entities. Strengthen the application of big data analysis in enterprise credit supervision, continue compiling the China Enterprise Credit Index, optimize the compilation plan, create an enterprise credit trend "barometer," and enhance the ability to prevent and resolve various potential, emerging, and trending credit risks.
7. Strengthen credit constraints and incentives. Study and formulate policy documents on strengthening dishonesty punishment and creditworthiness incentives. Carry out special actions to govern serious illegal and dishonest behaviors. Accelerate the revision of normative documents related to credit repair management by the administration, expand the scope of credit repair, and improve the credit repair mechanism. Utilize public disclosure to incentivize enterprise credit, mark and disclose enterprises that have received honors in the public system, and enhance the sense of gain for enterprises with good credit.
8. Deepen credit improvement actions, fully promote the credit commitment system, build a closed-loop management system around credit commitment, promise verification, dishonesty punishment, and credit repair, facilitating business entities to obtain licenses or repair credit through commitments.
9. Promote the normalized operation of enterprise credit alliances, follow the principles of government guidance, enterprise leadership, voluntary participation, and collaborative governance, further play the exemplary role of honest enterprises, encourage more enterprises to keep promises and value credit, and improve the overall market credit level.
10. Promote the facilitation of business entity registration and cancellation, fully implement simplified cancellation and ordinary cancellation systems, and improve the "one-stop service" platform for enterprise cancellation. Promote the introduction of cross-department business closure policy guidelines. Further optimize enterprise startup services. Promote the sustained and healthy development of individual industrial and commercial households, implement precise support by type and category. Optimize policies related to the conversion of individual industrial and commercial households to enterprises and reduce conversion costs.
II. Increase Policy Support for the Private Economy
11. Improve the credit information collection, sharing, and disclosure system, include commitment and performance information in credit records. Develop a credit supervision standard system for business entities, promote the implementation and use of enterprise credit supervision data collection, sharing, and application by localities and departments. Deepen the action to improve the quality of business entity credit supervision data, support the "three supervisions" with high-quality data. Improve the credit rating and evaluation system for small, medium, and micro enterprises and individual industrial and commercial households.
12. Provide more convenient and accessible annual report services for individual industrial and commercial households. Continuously expand the scope of "multiple reports in one," effectively reduce enterprise burdens. According to the "Regulations on Ensuring Payment to Small and Medium-sized Enterprises," carry out annual report disclosure of the number and amount of contracts where large enterprises have overdue payments to small and medium-sized enterprises.
13. Establish a support policy "exemption from review and immediate enjoyment" mechanism for private small, medium, and micro enterprises and individual industrial and commercial households, promote the notification and commitment system, and no longer require duplicate submission of materials that can be obtained through public data platforms. Strengthen policy release and interpretation guidance directly targeting individual industrial and commercial households. Cooperate with relevant departments to build a platform for matching employment information of private enterprises, individual industrial and commercial households, and job seekers.
III. Strengthen the Legal Protection for the Development of the Private Economy
14. Carry out special law enforcement actions to "guard" against unfair competition, severely crack down on unfair competition behaviors such as infringement of trade secrets, counterfeiting and confusion, and illegal acts such as malicious trademark squatting.
15. Continuously deepen the "double random, one public" supervision, promote the construction of a unified work platform, advance cross-department comprehensive supervision, implement "one industry, one inspection" to avoid multiple law enforcement and repeated inspections, reduce the burden on enterprises, and improve regulatory efficiency.
16. Deepen the construction of fair and civilized law enforcement conduct. Build a closed-loop management model of "prevention first, exemption for minor offenses, severe punishment for serious violations, proportional penalties, and post-penalty follow-up visits" to serve fair competition and ensure high-quality development through administrative law enforcement. Encourage cross-administrative region joint law enforcement.
17. Continue to carry out rectification of illegal charges involving enterprises to reduce the cost burden on enterprises. Conduct supervision and inspection of illegal charges involving enterprises, and carry out "review" on the governance of illegal charges. Smooth the complaint and reporting channels for illegal charges involving enterprises, establish a standardized mechanism for sharing and transferring problem clues among departments, and comprehensively implement joint sanctions through market supervision, industry supervision, credit supervision, and other means, focusing on exposing typical cases of illegal charges.
IV. Focus on Promoting High-Quality Development of the Private Economy
18. Support and guide private enterprises to improve their corporate governance structure, regulate shareholder behavior, strengthen internal supervision, achieve standardized governance, effective checks and balances, and compliant operation, and encourage qualified private enterprises to establish and improve the modern enterprise system with Chinese characteristics.
19. Support private enterprises to enhance standardization capabilities, participate in the formulation and revision of national standards, and provide opinions and suggestions during the national standard project initiation, drafting, technical review, as well as standard implementation information feedback and evaluation processes. Support private enterprises in leading the establishment of international professional standard organizations and actively promote standardization construction. Co-host the 2023 Private Economy Standard Innovation Conference with the All-China Federation of Industry and Commerce, carry out the Private Economy Standard Innovation Week activities, organize pilot "standard health check" for small and micro private enterprises, and promote various levels of the Federation of Industry and Commerce and affiliated chambers of commerce to actively carry out "standard leader" activities for private enterprises and "leading" activities for chamber group standards.

Support private enterprises in participating in the construction of industrial metrology testing centers to improve their advanced measurement capabilities.
21. Promote transparency of platform rules and behavioral norms, and foster healthy development of the platform economy. Continue to carry out network market supervision and service demonstration zone creation, continuously release new momentum for platform economy development. Strengthen normalized supervision of internet platforms, establish and improve compliance promotion mechanisms for platform enterprises, reduce compliance operation costs for platform enterprises. Continuously launch "green light" investment cases for platform enterprises, regulate platform charging behaviors, guide win-win cooperation between platforms and small and medium merchants, and promote healthy development of the platform economy. V. Continue to Foster a Social Atmosphere that Cares for and Promotes the Growth of the Private Economy.
22. Strengthen news publicity. Use various forms such as press conferences and collective interviews comprehensively, increase policy interpretation efforts, enhance policy dissemination volume, and promote policy effectiveness release; increase publicity of achievements, combine highlight data on private economy market access and operation, typical experiences and practices from various regions, strengthen topic planning and positive interpretation guidance, and actively create a public opinion atmosphere conducive to the healthy development of the private economy.
