Ministry of Emergency Management and National Mine Safety Administration regarding Notice on Implementing the "Regulations on Coal Mine Safety Production"

Emergency management departments, coal mine safety supervision departments, coal industry management departments of all provinces, autonomous regions, municipalities directly under the Central Government, and Xinjiang Production and Construction Corps, provincial bureaus of the National Mine Safety Administration, and relevant central enterprises:

The "Regulations on Coal Mine Safety Production" (State Council Order No. 774, hereinafter referred to as the "Regulations") were promulgated on January 24, 2024, and will come into effect on May 1, 2024. To effectively promote and implement the Regulations, ensure better enforcement, and provide strong legal protection for coal mine safety production work, the following matters are hereby notified.

1. Fully recognize the important significance of the promulgation and implementation of the Regulations

The Regulations are a fundamental and core law in the field of coal mine safety production, of great significance to coal mine safety production work, reflecting the high attention of the Party Central Committee and the State Council to coal mine safety production. The Regulations comprehensively summarize the good experiences and practices accumulated in coal mine safety production work over a long period. They are an important legislative achievement formed in the process of implementing the new development concept and promoting high-quality development of mine safety production work. The promulgation and implementation of the Regulations are conducive to comprehensively standardizing coal mine safety production work, further implementing the main responsibility of coal mine enterprises for safety production, strengthening the responsibilities of coal mine safety supervision and inspection departments, and are of great significance for improving intrinsic safety levels and promoting a stable and positive coal mine safety production situation.

Effectively implementing the Regulations is a powerful measure to strengthen coal mine safety production work and prevent and resolve major coal mine risks and hidden dangers. It is an effective way to promote the transformation of coal mine safety production governance models toward proactive prevention. It will provide strong support and guarantee for standardizing coal mine enterprises' safety production operations, preventing and reducing coal mine production safety accidents, and promoting healthy economic and social development. Emergency management departments at all levels, coal mine safety supervision and inspection departments, coal industry management departments, and the majority of coal mine enterprises should fully recognize the importance of implementing the Regulations, conscientiously organize learning, publicity, and preparatory work before implementation, and effectively implement the provisions of the Regulations in actual work.

2. Extensively and deeply carry out learning and publicity

Emergency management departments at all levels (except those not responsible for coal mine safety supervision, hereinafter the same), coal mine safety supervision and inspection departments, and coal industry management departments should promptly organize learning and publicity activities to fully understand the important significance, legislative purpose, legal system, supervision and inspection content, legal responsibilities, and legal norms for coal mine enterprises contained in the Regulations. They should ensure that all administrative law enforcement personnel in the system study the Regulations word by word through special training classes, cadre rotation training, expert lectures, case-based law explanations, legal knowledge competitions, and other methods. Local party and government leaders should take the lead in studying and deeply learning, effectively transforming the learning and publicity of the Regulations into conscious actions to fulfill local responsibilities and vigorously promote coal mine safety. The responsibility system of "who enforces the law, who popularizes the law" should be strictly implemented, making full use of government websites, radio, television, internet, newspapers, magazines, new media, and other media to widely publicize the main content of the Regulations, so that the whole society pays more attention to and supports coal mine safety production work. Special teams should be organized to carry out precise publicity at the front line of coal mine enterprises, enabling the majority of coal mine enterprises and employees to deeply understand the relevant requirements of the Regulations.
Coal mine enterprises and their parent companies should carry out comprehensive and multi-level learning and publicity activities, fully utilizing their own cable TV stations, radio stations, websites, and new media to open special columns for learning and publicizing the Regulations. They should make full use of bulletin boards, wall newspapers, publicity columns, activity areas, and other publicity positions to focus on promoting relevant content of the Regulations. Slogans and posters should be hung in public activity places to create a strong publicity atmosphere. Enterprises are encouraged to leverage cultural and artistic groups to produce and perform short, vivid, and lively publicity programs combined with accident warning cases. Coal mine enterprises with conditions are encouraged to organize cultural performances, knowledge competitions, speech contests, special lectures, and other activities with the content of publicizing the Regulations, creating a good atmosphere of "respecting the law, learning the law, abiding by the law, and using the law" within the enterprise.

3. Conscientiously conduct self-inspection and self-correction against the Regulations

Coal mine enterprises and coal-related central enterprises must earnestly fulfill safety management responsibilities, conscientiously organize their enterprises and affiliated coal mines to conduct self-inspection and self-correction against the Regulations. Key inspection items include: whether the responsibility system for safety production of all employees is sound and implemented; whether the actual controller's primary responsibility for safety production is fulfilled; whether the "five positions" of mine manager and full-time deputy chief engineer are staffed as required; whether the main technical responsible persons are staffed as required and the technical management system is sound and implemented; whether the main responsible persons and safety production management personnel continuously maintain safety production knowledge and management capabilities; whether the leadership shift system is established as required; whether the safety personnel limit and underground working time management system are established as required; whether underground labor dispatch employment is prohibited; whether safety investment and the extraction and use of safety production funds are guaranteed as required; whether coal mine construction projects are designed, constructed, and accepted as required; whether coal mine production capacity verification is conducted as required; whether production plans and operational indicators are issued in violation of safety production conditions, etc.

All coal mines should conscientiously conduct comprehensive self-inspection and self-correction of their safety production work against the relevant provisions of the Regulations, focusing on the following: whether annual disaster prevention and handling plans are prepared as required; whether special designs are prepared as required; whether special safety technical measures are taken for specified hazardous operations; whether a safety risk classification and control system is established; whether an accident hidden danger investigation and management system is established and improved as required; whether disaster level identification is conducted as required; whether main production systems and safety facilities comply with the Regulations; whether there are the seventeen major accident hidden dangers stipulated by the Regulations, etc.

4. Strictly supervise and inspect according to the Regulations

Emergency management departments at all levels and coal mine safety supervision and inspection departments should take the Regulations as an important basis for carrying out safety supervision and inspection. In administrative licensing, routine law enforcement inspections, and supervision and inspection work, they must strictly exercise their powers in accordance with the relevant provisions of the Regulations. The Regulations should be the focus of law enforcement inspections, strengthening supervision and inspection of the implementation of the Regulations in key coal-producing areas and key coal mine enterprises. Combined with the ongoing three-year action for fundamental safety production governance, comprehensive safety risk and accident hidden danger investigations should be conducted, and the main responsibility of coal mine enterprises for safety production should be firmly implemented. Illegal acts violating the Regulations, especially enterprises with major accident hidden dangers, should be strictly investigated and dealt with according to law.

The emergency management department and the coal mine safety supervision and inspection department shall, in accordance with the requirements of the "Regulations", urge local governments to strictly implement the following: whether the provincial people's government has clarified the main body responsible for coal mine safety supervision according to the principle of hierarchical and classified supervision; whether the local people's governments above the county level have established a coordination mechanism for coal mine safety production work; whether other relevant departments of the local people's governments above the county level perform coal mine safety production duties according to their division of responsibilities and the law; whether the relevant competent departments of the local people's governments above the county level and township people's governments stop and investigate illegal coal mines according to regulations; whether the provincial coal mine safety supervision department approves safety facility designs and safety production permits according to regulations; whether the coal mine safety supervision departments above the county level prepare annual supervision and inspection plans according to regulations and conduct inspections according to the "Regulations", whether they establish a supervision and handling system for major accident hazards according to regulations, whether they accept coal mine enterprises that have been legally suspended and rectified according to regulations, and whether they strengthen supervision of coal mine safety production technical service institutions.

5. Carefully organize the publicity and implementation of the "Regulations"

Emergency management departments, coal mine safety supervision and inspection departments, and coal industry management departments at all levels shall effectively strengthen the organization and leadership of the publicity work of the "Regulations". The main responsible persons shall personally arrange and deploy, study and formulate publicity and implementation work plans based on local conditions, refine work tasks in stages, establish key task lists, and implement responsible units and persons item by item. Emergency management departments at all levels shall promote the inclusion of the publicity and implementation status of the "Regulations" into important content of safety production and fire protection work assessment and inspection. Provincial bureaus of the National Mine Safety Supervision Bureau shall enhance work initiative, fully play the role of supervision and political inspection, and supervise local governments and relevant departments to coordinate and promote publicity work.

All coal mine enterprises and their parent companies, as well as central enterprises involved in coal, shall establish a leadership group for implementation headed by the main responsible person. Based on the actual situation of the enterprise, they shall study and formulate targeted and practical publicity and implementation work plans, establish and improve work mechanisms, clarify the responsibilities of the main responsible person, the person in charge of division, the technical responsible person, and various departments, forming a publicity and implementation work mechanism where everyone is responsible, each fulfills their duties, and rights and responsibilities are clear.

Provincial coal mine safety supervision and inspection departments and central enterprises involved in coal are requested to submit the publicity and implementation work plans to the National Mine Safety Supervision Bureau by March 8, 2024. Provincial bureaus of the National Mine Safety Supervision Bureau are requested to promptly forward this notice to all coal mine enterprises within their administrative regions.
