Administrative Measures for National Metrology Technical Specifications
(Announced by the State Administration for Market Regulation on March 8, 2024, Order No. 89, effective from May 1, 2024)
Chapter 1 General Provisions
Article 1 To strengthen the management of national metrology technical specifications, ensure the unity of the national measurement unit system and the accuracy and reliability of measurement values, these measures are formulated in accordance with the "Metrology Law of the People's Republic of China" and other relevant laws and administrative regulations.
Article 2 The project initiation, formulation, approval and release, implementation, and supervision of national metrology technical specifications shall be governed by these measures.
Article 3 The national metrology technical specifications referred to in these measures are metrology technical specifications organized and approved for release by the State Administration for Market Regulation (hereinafter referred to as the Market Regulation Administration) and implemented nationwide, including national metrology verification system tables, national metrology verification procedures, national metrology instrument type evaluation outlines, national metrology calibration specifications, and other national metrology technical specifications.
Article 4 The Market Regulation Administration uniformly manages national metrology technical specifications and is responsible for project initiation, organization of formulation, approval and release, organization of implementation, and supervision.
Article 5 The formulation of national metrology technical specifications should help improve the transmission and traceability of measurement values, support metrology management, promote scientific and technological innovation, drive industrial development, facilitate trade, and implement national strategies.
Article 6 The formulation of national metrology technical specifications shall comply with relevant national laws, administrative regulations, and departmental rules, have a clear scope of application, scientific and reasonable requirements, and consider operational feasibility and economic implementation; except for projects that must be kept confidential, the entire process shall be open, transparent, and widely solicit opinions from all parties.
Article 7 Actively promote the adoption of international metrology specifications issued by the International Organization of Legal Metrology (OIML) and international technical documents issued by relevant international organizations. The adoption of international metrology technical specifications shall comply with relevant national laws and regulations and adhere to the principles of combining national conditions and focusing on effectiveness.
Article 8 The Market Regulation Administration organizes the establishment of national professional metrology technical committees and sub-technical committees (hereinafter collectively referred to as technical committees), responsible for project evaluation, drafting organization, solicitation of opinions, technical review, implementation effect evaluation, review, and promotion of national metrology technical specifications, and the interpretation of national metrology technical specifications under their jurisdiction.
The Market Regulation Administration may designate relevant national industrial metrology testing centers, national professional metrology stations, and other institutions to undertake the related work stipulated in the preceding paragraph according to work needs. When necessary, the Market Regulation Administration may directly organize the drafting of national metrology technical specifications.
Article 9 Departmental, industry, and local metrology technical specifications that are advanced, leading, have good implementation effects, and need to be promoted nationwide may be approved and released in the form of national metrology technical specifications after review by the Market Regulation Administration.
Article 10 The Market Regulation Administration legally owns the copyright of national metrology technical specifications.
Chapter 2 Project Initiation of National Metrology Technical Specifications
Article 11 The Market Regulation Administration publicly solicits project initiation proposals for national metrology technical specifications from society. Units and individuals may propose project initiation suggestions for national metrology technical specifications to relevant technical committees based on economic and social development and metrology legal management needs, or directly to the Market Regulation Administration.
Project initiation proposals should include the necessity, feasibility, scope of application, and compatibility with existing national metrology technical specifications for formulating national metrology technical specifications.
Article 12 Relevant technical committees shall evaluate project initiation proposals. Those deemed suitable for project initiation after evaluation shall submit project initiation applications to the Market Regulation Administration.
Project initiation application materials shall include the project application form and draft national metrology technical specifications.
The project application form shall include the necessity and feasibility of formulating national metrology technical specifications, the current status and development trends of domestic and international technical specifications, analysis of consistency with relevant international technical documents, key technical requirements or main content, implementation conditions, schedule, and expected economic and social benefits.
Article 13 If there are major disagreements on project initiation proposals within relevant technical committees, the Market Regulation Administration shall study the disputed content and provide handling opinions.
Article 14 If the Market Regulation Administration decides to approve the project initiation, it shall issue a project plan to the relevant technical committees.
Article 15 During the execution of the project plan, if it is found that formulating national metrology technical specifications is no longer appropriate, the project shall be revoked; if urgently needed, it may be supplemented; under special circumstances, it may be adjusted.
Article 16 The revocation, supplementation, or adjustment of project plans shall be proposed by relevant technical committees and implemented after approval by the Market Regulation Administration.
If the revocation, supplementation, or adjustment of project plans is not approved, the relevant technical committees shall implement according to the originally approved plan.
Chapter 3 Formulation of National Metrology Technical Specifications
Article 17 The Technical Committee shall organize the drafting units to implement the project plan in accordance with relevant national requirements.
The drafting units are responsible for the investigation, experimental verification, preparation, and handling of comments related to the drafting of national metrology technical specifications.
The drafting units shall have professionalism and broad representativeness.
Article 18 The formulation of national metrology technical specifications shall follow the writing rules requirements, and based on investigation, research, and experimental verification, draft the solicitation draft of the national metrology technical specifications, writing instructions, and other related materials.
When formulating verification procedures, calibration specifications, and type evaluation outlines, other related materials mainly include:
(1) Test reports. For the technical requirements specified in the national metrology technical specifications, the applicable objects within the scope shall be tested under specified experimental conditions and methods, using test data to prove their scientific rationality and feasibility.
(2) Measurement uncertainty evaluation reports. The scientific rationality of the specified technical requirements, experimental conditions, and experimental methods shall be analyzed using measurement uncertainty evaluation methods.
(3) If relevant international technical documents are to be adopted, the original text and Chinese translation shall be provided.
Article 19 The solicitation draft and writing instructions of the national metrology technical specifications shall be publicly solicited for opinions from society and relevant departments, enterprises, research institutions, social organizations, and other stakeholders.
The public solicitation period shall not be less than thirty days.
Article 20 The drafting units shall handle the collected opinions and form a summary table of solicited opinions. After revising and improving the solicitation draft, the national metrology technical specifications review draft shall be formed and submitted to the relevant technical committee.
Article 21 The Technical Committee shall review the national metrology technical specifications review draft according to the working procedures stipulated in the "National Professional Metrology Technical Committee Charter." The Technical Committee shall review the following content:
(1) Whether it complies with relevant national laws, administrative regulations, and departmental rules;
(2) Compatibility with relevant international technical documents, national metrology technical specifications, and national standards;
(3) The scientificity, advancement, rationality, and operability of the main technical content;
(4) The normativity and rigor of the national metrology technical specifications text;
(5) The scientific rationality of test reports and measurement uncertainty evaluation reports;
(6) Whether it complies with fair competition regulations;
(7) The adoption of opinions and the handling results of major divergent opinions.
Article 22 The national metrology technical specifications review draft shall be approved by more than three-quarters of the Technical Committee members. Drafting personnel shall not participate in the voting.
The review of the national metrology technical specifications shall result in a review opinion document, signed by all participating members. The review opinion document shall include the review form, time, place, list of participating members, review opinions, and conclusions on the technical specifications.
Article 23 The drafting units shall organize and form the approval draft and related approval materials based on the review opinions. After the Technical Committee's review and approval, they shall be submitted to the State Administration for Market Regulation. Related approval materials include:
(1) Official document for the approval of national metrology technical specifications;
(2) Approval form for national metrology technical specifications;
(3) Writing instructions;
(4) Summary table of solicited opinions;
(5) Review opinion document;
(6) Other related materials.
If the approval materials require providing test reports, measurement uncertainty evaluation reports, and original and Chinese translated versions of relevant international technical documents, they shall also be provided according to relevant requirements.
Article 24 The formulation of national metrology technical specifications shall generally not exceed twenty-four months from the issuance of the project plan to the submission of materials for approval. If the submission cannot be made within the specified period, an extension application shall be submitted to the State Administration for Market Regulation thirty days in advance, and the extension period shall not exceed twelve months.
If the project plan cannot continue to be executed, the national metrology technical specifications project shall be terminated after approval by the State Administration for Market Regulation upon the recommendation of the Technical Committee.
Chapter 4 Approval and Publication of National Metrology Technical Specifications
Article 25 The State Administration for Market Regulation shall review the approval materials of national metrology technical specifications and may entrust relevant institutions to conduct the review if necessary. Upon approval, the State Administration for Market Regulation shall assign a unified number and publish it in the form of an announcement.
Article 26 The numbering of national metrology technical specifications consists of a code, sequence number, and year of publication.
The code "JJG" is used for national metrology verification procedures and national metrology verification system tables; the code "JJF" is used for national metrology calibration specifications, national metrology instrument type evaluation outlines, and other national metrology technical specifications.
Article 27 Materials formed during the formulation of national metrology technical specifications shall be archived separately by the State Administration for Market Regulation and relevant technical committees.
Article 28 After approval and publication, national metrology technical specifications shall be published by publishing institutions entrusted by the State Administration for Market Regulation.
The State Administration for Market Regulation shall publicly disclose the digital text of national metrology technical specifications in accordance with relevant regulations.
National metrology technical specifications that need to be translated into foreign languages shall be organized and reviewed by relevant technical committees; if publication is required, it shall be approved by the State Administration for Market Regulation and published by entrusted publishing institutions.
Chapter 5 Implementation and Supervision of National Metrology Technical Specifications
Article 29 A reasonable transition period shall be set between the publication and implementation of national metrology technical specifications.
Article 30 After the publication of national metrology technical specifications, the State Administration for Market Regulation shall organize the Technical Committee to carry out publicity, implementation, and promotion work. Market supervision departments at all levels, relevant government departments, industry associations, and metrology technical institutions are encouraged to use various forms to carry out publicity and promotion of national metrology technical specifications.
Article 31 Market supervision departments at all levels, relevant government departments, industry associations, metrology technical institutions, and Technical Committees are encouraged to collect information on the implementation of relevant national metrology technical specifications in their daily work; drafting units shall effectively track the validity of published metrology technical specifications.
The public is encouraged to provide feedback on problems and suggestions arising from the implementation of national metrology technical specifications through channels such as the State Administration for Market Regulation's portal website.
Article 32 The State Administration for Market Regulation establishes a national metrology technical specification implementation effect evaluation mechanism and regularly organizes evaluations of the implementation effects of national metrology technical specifications in key areas. The evaluation mainly includes the applicability, coordination, technical level, structural content, application status, implementation effectiveness, and issues of the technical specifications.
Article 33 The State Administration for Market Regulation entrusts technical committees to carry out the review of national metrology technical specifications. The technical committees shall propose conclusions on whether to continue validity, revise, or abolish based on the review, and report to the State Administration for Market Regulation. The review cycle generally does not exceed five years.
All technical committees shall closely monitor major international and domestic changes that may affect the legality and scientific nature of national metrology technical specifications, or situations where economic, social, and technological development cause the existing national metrology technical specifications or parts thereof to become inapplicable, and promptly propose review suggestions to the State Administration for Market Regulation after assessment.
Article 34 The reviewed national metrology technical specifications shall be handled according to the following situations:
(1) For national metrology technical specifications that do not require revision, confirm continued validity. The relevant technical committee shall fill out the review opinion form and submit it to the State Administration for Market Regulation for approval.
(2) For national metrology technical specifications that require revision, the relevant technical committee shall fill out the review opinion form and submit it to the State Administration for Market Regulation for approval, and include it in the revision plan; the sequence number of the revised national metrology technical specification remains unchanged, and the year is changed to the year of approval and release after revision.
(3) For national metrology technical specifications that no longer comply with relevant national laws and regulations or economic and social development needs, the relevant technical committee shall fill out the review opinion form, propose abolition suggestions, and submit them to the State Administration for Market Regulation for approval. The proposed abolished national metrology technical specifications shall be publicly solicited for opinions by the State Administration for Market Regulation, with a solicitation period of no less than thirty days.
Article 35 The catalog of national metrology technical specifications confirmed to continue validity or approved for abolition after review shall be published by the State Administration for Market Regulation in the form of an announcement.
Article 36 After the release of national metrology technical specifications, if individual technical requirements need adjustment, supplementation, or deletion, they can be modified through modification sheets. The drafting unit shall fill out the application form for modifying national metrology technical specifications, which shall be reviewed and approved by the relevant technical committee and submitted to the State Administration for Market Regulation for approval and published in the form of an announcement. The modification sheets of national metrology technical specifications have the same legal effect as the technical specification texts.
Chapter 6 Supplementary Provisions
Article 37 No unit or individual shall arbitrarily alter national metrology technical specifications without the approval of the State Administration for Market Regulation. Violations of these measures shall be dealt with according to laws, regulations, and discipline against the directly responsible persons.
Article 38 Departmental, industry, and local metrology technical specifications shall be implemented with reference to these measures.
Article 39 These measures shall come into effect on May 1, 2024. The "Administrative Measures for National Metrology Verification Procedures" promulgated by Order No. 36 of the former State Administration of Quality Supervision, Inspection and Quarantine on December 31, 2002, shall be repealed simultaneously.
