State Council's 2024 Legislative Work Plan

I. Resolutely implement the decisions and deployments of the CPC Central Committee, serving and safeguarding the overall work of the Party and the country with high-quality legislation

Closely focus on the legislative needs of Chinese-style modernization, accurately grasp the "major national issues," insist on highlighting key points, prioritizing urgent needs, and coordinating overall considerations, and scientifically and reasonably arrange legislative projects.

Focusing on promoting high-quality development, Submit to the Standing Committee of the National People's Congress for review the draft Private Economy Promotion Law, the draft amendments to the Tendering and Bidding Law, the draft National Development Planning Law, the draft Energy Law, the draft Atomic Energy Law, the draft amendments to the Accounting Law, the draft amendments to the Banking Supervision Law, the draft amendments to the Anti-Unfair Competition Law, the draft Farmland Protection and Quality Improvement Law, the draft amendments to the Fisheries Law, and the draft amendments to the Civil Aviation Law. Focusing on strengthening foreign-related rule of law construction, Submit to the Standing Committee of the National People's Congress for review the draft amendments to the Arbitration Law, the draft amendments to the Anti-Money Laundering Law, the draft amendments to the Foreign Trade Law, and the draft amendments to the Maritime Law. Formulate the Dual-Use Items Export Control Regulations and the Regulations on International Cruise Ships Docking and Resupplying at Ports of the People's Republic of China. Prepare to submit to the Standing Committee of the National People's Congress for review the draft amendments to the Customs Law. Prepare to formulate the Commercial Mediation Regulations; prepare to revise the Regulations on the Administration of Foreign Labor Cooperation and the Measures for the Use of the National Emblem Pattern Abroad. To promote world peace and development, actively participate in the reform and construction of the global governance system, and carry out the review of relevant international treaties.

At the same time, for legislative projects urgently needed for comprehensively deepening reform, transforming government functions, and national security, as well as legislative projects related to accelerating the modernization of national defense and the military, and other legislative projects assigned by the Party Central Committee and the State Council, relevant departments of the State Council should expedite handling and complete drafting and review tasks as soon as possible. For other legislative projects under study but not included in the legislative work plan, relevant departments should continue research and demonstration.

II. Strengthen and improve legislative work in the new era, further enhance the quality and efficiency of legislation

Adhere to the Party's comprehensive leadership over legislative work. Adhere to guiding legislative work with Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, especially Xi Jinping's thought on the rule of law, fully exert the Party's core leadership role in overall planning and coordination, implement the Party's leadership throughout all stages and aspects of legislative work, and ensure the correct political direction.

Adhere to legislation for the people and seek truth and pragmatism. Adhere to the people-centered development philosophy, deeply practice whole-process people's democracy, strengthen the construction of legislative contact points, fully listen to opinions from experts, scholars, and all sectors, and actively respond to the new demands and expectations of the people regarding legislative work. Based on the great practice of building Chinese-style modernization, solidly carry out legislative investigation and research to enhance the pertinence and applicability of laws, regulations, and systems. Improve legislative models, explore establishing a rapid legislative response mechanism for legislative matters strongly reflected by the people and urgently needed for economic and social development, and promote "small, fast, smart" and "small incision" legislation.

Firmly safeguard the unity, dignity, and authority of the national legal system. Adhere to the simultaneous advancement of legislation, amendment, abolition, and interpretation, strengthen legislative linkage within the same and related fields, and promptly issue supporting legal provisions as required; adhere to combining comprehensive and special cleanups to powerfully and orderly advance the cleanup of laws and regulations. Strengthen legal guarantees for major national reforms, fully play the guiding, promoting, regulating, and safeguarding role of legislation. Strengthen the filing and review of regulations and rules, adhere to the principles of "all items must be filed, all filings must be reviewed, and all errors must be corrected," increase review and error correction efforts, and improve the quality and efficiency of filing review work.

Strengthen publicity and interpretation throughout the legislative process. Adhere to the organic combination of legislation and popularizing the law, guide broad social participation in legislation according to the characteristics and needs of each legislative stage, enhance the effectiveness of legislative publicity, promptly respond to social concerns, and create a good atmosphere for the enactment and implementation of laws and regulations. Actively explain the concept, culture, and practice of socialist rule of law with Chinese characteristics, and tell the story of China's rule of law in the new era well.

Continuously improve the legislative work level of local governments. Local government legislation should adhere to problem orientation, demand orientation, and effect orientation, strictly comply with legislative authority and procedures. Encourage local governments to actively explore and practice regional collaborative legislation. Vigorously strengthen the construction of local government legislative workforces, fully equip and strengthen workforces, and organize special training programs according to plans.

III. Strengthen responsibility and effectively implement the legislative work plan

All departments of the State Council must attach great importance to legislative work, strengthen organizational leadership, improve work mechanisms, tighten and implement responsibilities, and strengthen progress management to improve legislative work efficiency while ensuring legislative quality.

Drafting departments must strictly follow requirements to complete drafting work, reserving reasonable time for review and deliberation. When draft laws and regulations submitted for review involve departmental responsibilities, administrative licenses, financial support, tax incentives, etc., consent must be obtained from relevant departments such as institutional organization, review and reform, finance, and taxation; if there are major disagreements between departments, the drafting department should actively coordinate to reach consensus; before submitting draft laws and regulations for review, the drafting department should promptly communicate with the Ministry of Justice, explaining the solicitation of opinions and coordination of major disagreements.

The Ministry of Justice should strengthen overall coordination, supervision, and guidance, proactively understand relevant situations, strictly control legislative review, effectively safeguard national interests and the fundamental interests of the people, and prevent departmental interests from influencing legislation. For major legislative projects with tight schedules and high difficulty, intervene early if necessary and organize special teams to actively promote progress. For legislative projects with prominent focal conflicts, increase coordination efforts to prevent prolonged delays.
