The "Regulations on the Implementation of the Consumer Rights Protection Law of the People's Republic of China" will take effect on July 1, 2024. The regulations supplement operators' obligations regarding the protection of elderly and minor consumers' rights; prohibit operators from using technical means to force or disguise forcing consumers to purchase goods or accept services; require operators who provide services through automatic extension or automatic renewal to prominently notify consumers before service acceptance and before the automatic extension or renewal date; require operators who fail to provide goods or services as agreed to fulfill the agreement or refund prepayments upon consumer request; and require operators with major business risks that may affect normal provision of goods or services according to contract or trade customs to stop collecting prepayments.

A Party or Government Agency May Establish Only One Portal Website

The Office of the Central Cyberspace Affairs Commission and three other departments have formulated and issued the "Internet Government Application Security Management Regulations", effective from July 1, 2024. The regulations require that the construction and operation of internet government applications comply with relevant laws, administrative regulations, and mandatory national standards, adopt technical and other necessary measures to prevent risks such as content tampering, attack-induced paralysis, and data theft, and ensure the safe and stable operation of internet government applications and data security. The regulations also require that a party or government agency may establish only one portal website. The names of internet government applications should preferably use the name of the entity or standardized abbreviation; if other names are used, they should generally adopt a naming method combining regional name and responsibility name, and prominently display the entity name.

Which Energy-saving and New Energy Vehicles Are Eligible for Vehicle and Vessel Tax Discounts? Three Departments Adjust Technical Requirements

The Ministry of Industry and Information Technology, Ministry of Finance, and State Taxation Administration jointly issued the "Announcement on Adjusting Technical Requirements for Energy-saving and New Energy Vehicle Products Eligible for Vehicle and Vessel Tax Discounts", adjusting technical requirements for such vehicles. The announcement takes effect on July 1, 2024.

Among new energy vehicle products, plug-in (including extended-range) hybrid passenger cars must have a conditional equivalent all-electric range of no less than 43 kilometers. Pure electric buses (excluding fast-charging types) must have a range of no less than 200 kilometers. Plug-in hybrid (including extended-range) buses must have a pure electric range of no less than 50 kilometers. Pure electric trucks must have a range of no less than 80 kilometers. Plug-in hybrid trucks (including extended-range) must have a pure electric range of no less than 50 kilometers. For fuel cell commercial vehicles, the pure hydrogen range must be no less than 300 kilometers. The policy also specifies other technical condition requirements.

The National Financial Regulatory Administration has revised and issued the "Fixed Asset Loan Management Measures", "Working Capital Loan Management Measures", and "Personal Loan Management Measures", effective from July 1, 2024. The key revisions include: first, reasonably broadening the scope of fixed asset loans and working capital loans in terms of usage and loan recipients, optimizing the calculation requirements for working capital loans to meet the actual demand of the credit market. Second, adjusting and optimizing the entrusted payment amount standards, moderately extending the entrusted payment time limits to enhance flexibility. Third, clarifying forms of handling such as video interviews and off-site investigations to accommodate new financing scenarios in line with online credit processing needs. Fourth, specifying loan term requirements to guide commercial banks in effectively preventing loan term mismatch risks and further optimizing loan structures. Fifth, further strengthening credit risk control to promote the standardization of credit management by commercial banks. Sixth, incorporating the "Project Financing Business Management Regulations" as a special chapter into the "Fixed Asset Loan Management Measures".

New policies on filing and approval of overseas contracted projects

The Ministry of Commerce issued the "Administrative Measures for Filing and Approval of Overseas Contracted Projects", effective from July 1, 2024. The "Management Measures" stipulate that enterprises register their information through the unified platform of the Ministry of Commerce's business system for overseas contracted project management, handle project filing and approval, and report subsequent project progress. Enterprises can submit relevant materials online and print filing and approval receipts online when handling related business. The "Management Measures" require enterprises to fill in the filing form online before overseas bidding or signing contracts for general projects. After the commerce authority accepts the enterprise's filing form, the enterprise can print the filing receipt within 3 working days. Enterprises are responsible for the authenticity, accuracy, and completeness of the filing information.
